Those are two regimes with two purposes, run by different bodies at different counters, and out here nothing connects them. The whole county is in, and the boundary is the county line
Chambers is one of the fourteen first-tier coastal counties the Commissioner of Insurance has designated, and unlike Harris next door it is not split. The Texas Department of Insurance puts it plainly: except for Harris County, the entire county of each county on the map is part of the windstorm program. That makes the county line itself the edge of the programme on two sides. Cross north into Liberty County and you are out of it. Cross west into unincorporated Harris County and you are out of it. Cross east into Jefferson County and you are still in. The identical tract of land is inside or outside depending on which side of a county line it sits.

Two codes reach the same building, for two different reasons
Chambers County has adopted no residential building code, so nothing the county does looks at the structure. Separately, under 28 TAC section 5.4013, construction in the designated catastrophe area begun on and after 1 April 2026 must comply with the 2024 IRC or the 2024 IBC to be eligible for catastrophe property insurance. That is an insurance rule, not a building code adoption, and it does not displace anything. Inside a city, the city's code governs the permit while the state rule governs insurability. Outside every city here, there is no local code to govern the permit at all, and the 2024 edition is the only one in the picture.

What the certificate is worth, in statute
Insurance Code section 2210.258(b) says the association may not insure a structure in the catastrophe area until a certificate of compliance has been issued for it. That binds TWIA, not just the owner. TWIA's own wording is that without a certificate a structure may be considered uninsurable and ineligible for coverage with TWIA. The chain is a WPI-1 application to TDI before work starts, a WPI-2 inspection verification during construction, then the WPI-8. Statute requires the written notice of intent before the work begins. The completed-construction route is engineer-only, and TDI notes that inspecting a finished building is harder and may cost more.

The county issues a building permit and never opens a code book
The Permit Office requires a permit for any residential development, additions and remodelling included, and its own page names what the permit is checked against: Subdivision Regulations, Drainage Criteria, Fire Code and Environmental Health. No building code is on that list. The published residential sequence runs address verification and floodplain review, then fees, then septic and the electric-power release. A design or floor plan is uploaded, and the county's own examples name homes, shops and carports. But no adopted edition, no design criterion and no structural inspection appear anywhere in it. The fee is $150 per building, and starting work first doubles it.

The septic order: every tract, licensed installers, and the shop stays out of it
The county's on-site sewage facilities order was adopted 24 June 2025 and approved by the TCEQ executive director on 9 October 2025. Its list of stricter-than-state rules is short and complete. A permit and inspection are required regardless of size of the tract of land, which settles the ten-acre question in the county's own words. There are no homeowner installations unless the homeowner is a licensed installer. And subdivisions platted after 1 June 2006 on public water need lots of at least 32,670 square feet. What the order does not do is redefine living area, so the state rule holds and capacity keys off living space rather than total footprint. In Chambers the workshop does not enlarge the drainfield.

The growth is landing outside the towns
Chambers County went from 46,539 people in 2020 to 57,594 in 2025, up 23.8 percent, which is more than double the next fastest county on this stretch of coast. The part that matters for land buyers is where it went. The unincorporated balance of the county rose from 26,976 to 34,302, up 27.2 percent, faster than the county as a whole. The Chambers portion of Mont Belvieu grew 38 percent. Over the same five years Jefferson County next door lost population, and so did Nueces. This is the one growing county in the Texas windstorm belt.

Freeboard is two feet, and it reaches the 500-year floodplain
The county's floodplain regulations apply to all areas of special flood hazard as well as those in the 500-year floodplain, which is wider than most Texas counties regulate. New residential construction must have its lowest floor, including all essential electrical, heating, ventilation, plumbing and air conditioning equipment and duct work, elevated at least two feet above the base flood elevation or one foot above the 500-year floodplain elevation, whichever is higher. An engineer, architect or land surveyor certifies it. Enclosures below the lowest floor need a non-conversion agreement filed with the deed and are subject to annual inspection.

The county fire code exempts the short-term rental and catches the business shop
Chambers adopted the 2021 International Fire Code on 14 January 2025, with the 2021 IBC by reference, under Local Government Code chapter 233. It reaches commercial establishments, public buildings and multifamily of four or more units, so a house you live in is outside it, and it goes further and says so: Airbnb and temporary vacation rentals consisting of a single-family dwelling originally constructed as a single-family dwelling shall not be regulated by this code. What does pull you in is the outbuilding. Section 105.2.4.1 reaches any commercial building, structure or operation located in a residential subdivision, including those which store items or inventory related to a business, and conversions of single-family dwellings, and those permits issue only on approval of the Commissioners Court.

The engineer requirement here is about wind, not clay
Everywhere else in Texas a private dwelling can be built without a licensed engineer. Occupations Code section 1001.056(c)(1) switches that exemption off for anyone providing engineering design or inspection services necessary to comply with windstorm certification standards under Subchapter F, chapter 2210 of the Insurance Code. The legislature carved the coast out by name in 2009. The TDI rule then sets out the engineered route in terms: the inspector verifies that the work conforms to a sealed design by a Texas-licensed professional engineer. Separately, the county's floodplain rules require an engineer, architect or land surveyor to certify the finished floor elevation.

The five largest soil map units in Chambers County are all clay or silty clay, and units named clay cover about 55 percent of the survey area. This is not a place where the surface hides what is underneath. The Beaumont series reads 52.7 percent clay in the top five inches and 57.1 percent below it; League reads 48.5 percent at the surface and 60.1 percent at depth. Their taxonomic names end in -erts, which is the Vertisol order, the shrink-swell clays. Beaumont's seasonal high water table sits about five inches down in January, and Harris clay, the single largest map unit in the county, is mapped very poorly drained, hydric and frequently flooded.

The ten-acre platting exemption is not self-executing
State law does not let the county require a plat when every lot is over ten acres, or for agricultural, ranch, wildlife management or timber use, or where all lots go to relatives within the third degree. Chambers accepts all of that and then adds a step. The owner gives the County Engineer written notice of the intent to divide, names the exception relied on and provides a sketch, and for the county's own additional exceptions swears an affidavit setting out the basis, subject to penalties of perjury, with copies of the deeds. The county may also require restrictions running with the land. One county exception is worth knowing early: a tract whose boundary has not changed since 21 February 1985 may be sold whole without platting.

Who your septic authority actually is
TCEQ's authorised agent register names the Chambers County Authorized Agent for the entire county except the cities of Anahuac and Beach City. Beach City holds its own record for its city limits. Old River-Winfree holds a record too, but its area served reads administered by Chambers County, so the city is the agent on paper and the county does the work. The county office is at 201-A Airport Road in Anahuac, on (409) 267-2702, and the register carries the county's current order as a download, which is how the order and the county's own published copy confirm each other.

Mont Belvieu wired the two regimes together, and that is why they are separate
Mont Belvieu adopted the 2024 International Residential Code by Ordinance No. 2026-002 on 12 January 2026, with a single amendment that only changes the code's title. Then it passed section 10-39, Windstorm inspections required, which makes a copy of the WPI-1 a condition of starting work and verification of the WPI-8 a condition of final building inspection, and applies the same wind-load requirement to accessory structures over 200 square feet. A city had to legislate to make the building permit and the windstorm certificate touch each other. Out in the unincorporated county nothing does that, so the two run on separate tracks and neither one tells you about the other.

Only one jurisdiction in the county has adopted a residential code
Anahuac is the county seat, and its Code of Ordinances section 150.01 lists the codes it has adopted: the 2018 International Mechanical, Plumbing, Energy, Fire, Fuel Gas, Property Maintenance and Existing Building Codes, and the 2017 National Electrical Code. Neither the International Residential Code nor the International Building Code appears on that list. Texas puts every municipality on the residential code as it existed in May 2012 as a statewide floor whatever the city adopts, so this is a fact about Anahuac's list rather than a vacuum. But it means Mont Belvieu is the only jurisdiction in Chambers County that has affirmatively adopted a residential edition of its own.

A third of the county is water
Chambers County covers 597 square miles of land and 274 square miles of water, so 31 percent of it is Galveston Bay, Trinity Bay and East Bay. What is left works out at about 57 people per square mile in the unincorporated area, which is the measure that matters when you are looking for acreage rather than a lot. For comparison, Montgomery County is 79 percent unincorporated and carries more than 590 people per square mile out there. Unincorporated share and rural are not the same thing, and Chambers is the genuine article.

What moves a Texas budget is usually below grade, and it is soil rather than rock: shrink-swell clay. The Blackland Prairie and the Gulf Coast clays move enough between a wet season and a dry one to drive the foundation design across the state's largest markets, which is why several DFW cities require an engineer's seal on the foundation of every new house. Those are the same conditions that decide whether a septic field passes its soil and site evaluation, so the grading plan, the foundation and the drainfield get resolved together rather than one at a time. Does a barndominium in Chambers County need a windstorm certificate?
If you want TWIA to insure it, yes, and the whole county is in scope. Chambers is one of the fourteen first-tier coastal counties the Commissioner of Insurance has designated, and the Texas Department of Insurance states that except for Harris County, the entire county of each county on its map is part of the windstorm program. There is no line through Chambers the way there is through Harris, so this is not a parcel-level question here. It is a county-line question: Liberty County to the north is outside the programme and unincorporated Harris County to the west is outside it, while Jefferson County to the east is inside. The sequence starts before you break ground: a WPI-1 application to TDI, a WPI-2 inspection verification while the work is going up, then the WPI-8 certificate. Statute requires the written notice of intent to build before the work begins.
There is no county building code. So what actually applies to my house?
Two things, from two directions, and they are not the same thing. The county has adopted no residential building code, so on unincorporated land nobody reviews or inspects the structure. Separately, under 28 TAC section 5.4013 the 2024 IRC or 2024 IBC applies to construction begun on and after 1 April 2026 as the standard the building must meet to be eligible for catastrophe property insurance. That is a Department of Insurance rule about insurability, not a building code adoption, and it does not override or replace anything. Where a city code also applies, both apply: the local code governs the permit and the TDI rule governs whether TWIA will insure it. Out in the unincorporated county there is no local code at all, so the 2024 edition is the only one in the picture, and the practical result is that this land is subject to the newest residential code in Texas while the county enforces none of it. Worth knowing: the county permit does not check windstorm compliance and the TDI certificate does not check the county permit.
What permits does the county actually require?
A residential development permit for any construction, addition or remodel, at $150 per building, applied for through the My Government Online portal with proof of ownership and a design or floor plan. A septic permit if you are on an on-site system, at $245 with a $123 re-inspection fee, and the septic has to pass its site inspection before permanent power is released. A floodplain development permit if you are in the special flood hazard area or the 500-year floodplain, with elevation certificates before and after. A culvert permit from Road and Bridge if you are cutting a driveway into the county right of way. And a plat, or a written exception accepted by the County Engineer, if you are dividing land. Beginning any of that work before the permit issues doubles every fee on the schedule.
How big does the septic field have to be, and does the shop count?
The shop does not count in Chambers County, and that is worth money. Texas sizes a system from living area rather than total footprint, and the county's own on-site sewage facilities order, adopted 24 June 2025, does not redefine living area the way some authorised agents do. So a barndominium with three bedrooms of living space and a large workshop is sized on the living space. What does drive the number here is the ground. Texas classifies soil by texture rather than by a percolation test, and clay is the slowest class in the table, so a Chambers County field is large for its flow. The order also requires a permit and inspection regardless of the size of the tract of land, and it does not allow homeowner installations unless the homeowner is a licensed installer. A licensed site evaluator or a professional engineer does the site evaluation.
Do I need an engineer?
For the windstorm work, yes. Occupations Code section 1001.056(c)(1) removes the private-dwelling exemption from the Engineering Practice Act for anyone providing engineering design or inspection services necessary to comply with windstorm certification standards under chapter 2210 of the Insurance Code. The legislature carved the coast out by name in 2009. The TDI rule then gives the engineered route in terms: the inspector verifies that the work conforms to a sealed design by a Texas-licensed professional engineer. Separately, the county's floodplain rules require a registered professional engineer, architect or land surveyor to certify the finished floor elevation. And a clear-span steel frame with wide door openings is engineered work whatever the law says, because the prescriptive code tables are written for conventional light-frame construction.
I plan to rent it out or use part of it for my business. Does that change anything?
It can, and Chambers answers the question more precisely than most Texas counties. The county fire code, adopted 14 January 2025 on the 2021 IFC, states that Airbnb and temporary vacation rentals consisting of a single-family dwelling originally constructed as a single-family dwelling are not regulated by it, and it says the same of an owner-occupied lodging house under four guestrooms. So letting the house, on its own, does not pull you into the fire code. What does is the outbuilding. Section 105.2.4.1 reaches any commercial building, structure or operation located in a residential subdivision, including those which store items or inventory related to a business or house personnel connected to a business, and it reaches conversions of single-family dwellings into the listed uses. Those permits issue only on approval of the Commissioners Court. If the workshop is going to hold business stock, raise it with the Permit Office on (409) 267-2700 before you design it.
What is the ground like out there?
Heavy, flat and wet. The five largest soil map units in the county are all clay or silty clay, no slope in the fifteen largest exceeds one percent, and roughly 55 percent of the survey area is mapped as clay. Unlike the sandy claypans further inland, the surface here does not disguise the subsoil: the Beaumont series reads about 53 percent clay in the top five inches and 57 percent below it. These are Vertisols, the shrink-swell order, and the NRCS taxonomic names say so themselves. Seasonal high water tables sit within five to fifteen inches of the surface on the two most extensive poorly drained soils, and the largest single map unit in the county, Harris clay, is mapped frequently flooded and hydric. Plan the foundation, the drainage and the septic together rather than one after another.
Is there still land to buy here?
Yes, and this is one of the counties other pages send people to. Chambers covers 597 square miles of land, about 60 percent of the population lives outside every city limit, and the unincorporated area grew 27.2 percent between 2020 and 2025, faster than the county overall. That works out at roughly 57 people per square mile out there, against more than 590 in the unincorporated part of Montgomery County, which is a useful reminder that being mostly unincorporated and being rural are different things. The pressure comes from both ends, Houston and Baytown to the west and the Mont Belvieu petrochemical corridor in the middle, and it lands on unplatted acreage out toward Hankamer, Winnie, Wallisville and Double Bayou. Before you buy, check the flood zone, get a site evaluation for the septic, and settle whether the tract sits inside any city's extraterritorial jurisdiction.
