Liberty County grew 31.2 percent between 2020 and 2025, the fastest rate in the Houston ring, and almost all of it landed on rural acreage with no sewer. Out here the septic system is the project. The county's own permit guide says you must show proof of an existing on-site sewage facility, or buy a septic permit, before a building permit will be issued at all, and its flood damage prevention ordinance makes that permit apply to all construction regardless of where in the county it sits. So the drainfield is settled first and the building follows it. Liberty County is TCEQ's authorised agent for the unincorporated county, working under an order the Commissioners Court adopted on 24 October 2023 and TCEQ approved that December. The Blackland Prairie and the Gulf Coast clays move enough between a wet season and a dry one to drive the foundation design across the state's largest markets, which is why several DFW cities require an engineer's seal on the foundation of every new house. Those are the same conditions that decide whether a septic field passes its soil and site evaluation, so the grading plan, the foundation and the drainfield get resolved together rather than one at a time. We price the dirt before we price the building.

Is there a percolation test for septic in Liberty County?
No. Texas does not use percolation testing at all. A site evaluator or a professional engineer classifies the soil by texture, from Class Ia sandy and gravelly soils through Class IV silty clay and clay, and that class sets a loading rate running from above 0.50 down to 0.10 gallons per square foot per day. The absorptive area is the design flow divided by that rate. Any figure quoted to you in minutes per inch was imported from another state's rules.
Can sandy soil be a problem for a septic system here?
Yes, and in Liberty County it is a live possibility rather than a theoretical one. The state rule at 30 TAC section 285.33(b)(4)(D) says Class Ia soils do not provide adequate treatment of wastewater through soil contact, so the remedy is imported soil of a suitable class or a secondary treatment system with disinfection. The county genuinely spans both extremes: NRCS puts the national type location for the Segno fine sandy loam series just outside Cleveland, and describes the Beaumont clay series as the Gulf Coast Prairie of Texas east of the Trinity River, which runs through the county. So the site evaluation really does decide the answer here.
Does Liberty County require a building permit?
Yes, and it reaches further than people expect. The county's flood damage prevention ordinance says building or development permits must be secured from Liberty County on all new construction, applicable to all construction regardless of its location in the county, and the permit guide sets the trigger at any building 100 square feet or larger, listing homes, mobile homes, storage buildings, garages and workshops. The published fee is 125 dollars, or 125 dollars plus 15 cents per square foot in the floodplain, and working without a permit doubles it. What the county does not publish is an adopted residential code edition, a plan review or a structural inspection, so this is a permit that gates the build on septic and floodplain rather than a building code.
Where can I put the shop on a Liberty County lot?
Not wherever you like. Section 9(P) of the county's on-site sewage facility order makes it a violation for secondary structures such as a garage, storage building or shop to be erected within the established set back rules. In practice the drainfield and its clearances get laid out first and the shop is placed around them, which is the reverse of how most people sketch a barndominium. Get the site evaluation done before you fix the building footprint, not after.
Does my shop space count towards the size of the septic system?
Not at state level. TCEQ's application form asks for the number of bedrooms and the living area in square feet, and the wastewater usage table is headed number of bedrooms or living area of home. Both tests apply and the higher one governs, but the area figure is living area, not total structure area, so a large shop bay does not by itself enlarge the drainfield. Liberty County adopts several standards stricter than the state minimum, but redefining living area is not one of them. What its order does instead is control where that shop may stand.
I have more than ten acres. Am I exempt from the septic rules?
No, and TCEQ said so itself. When it amended the rule in 2023 the agency explained that the old wording had been misinterpreted by homeowners, installers, authorised agents and other stakeholders as meaning that single-family dwellings on ten acres or more were exempt from the entirety of Chapter 285. Ten acres buys you out of the paperwork and the inspection, not out of the standards the system still has to meet.
Who is allowed to design the septic system here?
In most of Texas the owner or the installer may prepare the planning materials for a standard single-family system. Liberty County has taken that option away. Section 9(H) of its order requires that all on-site sewage facilities, whether standard, non-standard or proprietary, be designed under the seal of a registered sanitarian or a registered licensed engineer. The site evaluation itself is done by a licensed site evaluator or an engineer, and section 9(I) requires original signatures, dates and seals on everything submitted.
How long does the septic authorisation take, and what catches people?
The site evaluation comes first. The application and planning materials follow, and 30 TAC section 285.3(c) gives the authorised agent 30 days to decide. The authorisation is good for one calendar year. What catches people is earlier than any of that: the county's permit guide requires an affidavit to the public to be signed, notarised and recorded at the county clerk's office, with a copy filed alongside the application, so there is a trip to the courthouse before anything is built. Section 9(K) then requires the installer to give five days' notice before final inspection, and section 11(b) requires the applicant, the licensed installer, the installer's apprentice or the engineer of record to be present at it.
How do I find out who runs the septic programme for my land?
TCEQ publishes a county-by-county authorised agent search. For Liberty County it returns three records, and the county's own area served is listed as unincorporated county only, so inside a city you are dealing with the city or with TCEQ's Houston region rather than the county. TCEQ's own instructions on the results page work through it in order: whether you are in a subdivision within 2,000 feet of a lake or river, then whether you are inside a city's limits, then the county.
What still applies on rural land even without a building code?
More than people expect. The septic authorisation is required before construction or operation, and the county will not issue a building permit without it. In a special flood hazard area the lowest finished floor must sit two feet above the base flood elevation, certified by an engineer, architect or land surveyor, and land in the floodway needs a no-rise certificate. Occupations Code section 1301.052 requires a licensed plumber on new construction even on rural land, because the rural exemption excludes new construction. Health and Safety Code section 388.004 requires a builder outside any municipality to certify energy compliance and keep the certification for three years. And recorded deed restrictions bind regardless, enforceable by anyone benefited by them.
