Hardin County is where the coastal regime stops. Its whole southern line is the Jefferson County line, and Beaumont is inside the Texas Department of Insurance windstorm programme, so a build twenty-five miles down US 69 has to meet the 2024 code and carry a certificate of compliance simply to be insurable against wind and hail. Kountze, Silsbee, Lumberton and the pine and bottomland north of that line are outside it. Insurance Code section 2210.003 names Hardin a second tier coastal county, and second tier is not designation: the commissioner has never designated it, so no windstorm certificate is required here and none can be issued. The other surprise is the septic. Hardin is one of a handful of Texas counties with no authorised agent at all, so the on-site sewage facility permit comes from the state, out of the Beaumont regional office, under the plain state rules with nothing added.

The Blackland Prairie and the Gulf Coast clays move enough between a wet season and a dry one to drive the foundation design across the state's largest markets, which is why several DFW cities require an engineer's seal on the foundation of every new house. Those are the same conditions that decide whether a septic field passes its soil and site evaluation, so the grading plan, the foundation and the drainfield get resolved together rather than one at a time. Do I need a windstorm certificate to build in Hardin County?
No. The Texas Department of Insurance windstorm programme covers a designated catastrophe area of fourteen whole counties plus part of Harris County, and Hardin is not one of them. Insurance Code section 2210.003 does name Hardin a second tier coastal county, which catches people out, but the second tier is only the pool from which the Commissioner of Insurance may designate a catastrophe area under section 2210.005, and Hardin has never been designated. So there is no WPI-1 to file before you start, no inspection verification during the build and no WPI-8 at the end. Jefferson County, which forms the whole southern boundary of Hardin, is inside the programme. Beaumont is inside it. Kountze, twenty-five miles up US 69, is not.
Then does the 2024 code apply to a barndominium here?
No, and it is worth being exact about what that rule does. From 1 April 2026 the Texas Department of Insurance requires that, to be eligible for catastrophe property insurance, a structure located in the designated catastrophe area comply with the 2024 International Residential Code or International Building Code. That is a condition of insurability, not a replacement for whatever code the city or county has adopted, and inside the area both apply at once. Hardin County is outside the area, so the condition simply never attaches. What code applies to your build here is a purely local question: Lumberton has adopted the 2015 International Residential Code, Silsbee the 2018 edition, and the 96.9 percent of the county's land outside every city limit falls under neither. The commissioners court has never adopted a residential code order for the unincorporated area. It came closest in April 2024, when the County Judge posted notice that the court would consider one and attached a draft; that draft stayed unsigned, the item was posted for discussion only, and it has not returned to an agenda since. The permit office on (409) 246-5251 is the place to settle it for your parcel.
Who issues the septic permit in Hardin County?
The state does. TCEQ's authorised agent search returns exactly one record for Hardin County, and it is TCEQ Region 10 in Beaumont. There is no county authorised agent, no city agent and no health district holding a delegated programme. The region's own record lists its area served as Hardin, Jasper, Newton, Sabine and Shelby counties. That is unusual in this corner of Texas, because both neighbours run their own: Jefferson County and Orange County are each the authorised agent for their unincorporated areas. In practice it means your on-site sewage facility application goes to 3870 Eastex Freeway in Beaumont, (409) 898-3838, and not to the courthouse in Kountze.
Does my shop space count towards the size of the septic system?
Not here. TCEQ's application form asks for the number of bedrooms and the living area in square feet, and the wastewater usage table is headed number of bedrooms or living area of home. Both tests apply and the higher one governs, but the area figure is living area, not total structure area. In many Texas counties the next question is whether the local authorised agent has adopted something stricter, because 30 TAC section 285.10 lets an agent do exactly that with written justification and TCEQ approval. Hardin County has no authorised agent, so there is no local instrument in which a stricter definition could live. Chapter 285 applies as written and the shop bay does not enlarge the drainfield.
What permits does Hardin County actually require?
More than most people expect, all of them from the Floodplain Administration. A residential development permit is required before any man-made change to real estate begins, at 100 dollars for the first 1,000 square feet of living area plus 25 dollars for each additional 100. A 30 dollar electrical service permit must be in hand before Entergy or SHECO will connect power. Culverts are 50 dollars each and the county installs them, the first one at no charge. There are separate permits for manufactured home placement, solar panels, landscape culverts, subdivisions and commercial or industrial development. What none of them includes is a code edition, a plan review or a structural inspection. The permit conditions are about when work may start, when the permit expires and access for the local administrator to verify compliance with the flood order.
Is the ground in Hardin County a problem to build on?
The problem here is water before it is anything else. Of the 575,002 acres the NRCS maps in the county, 268,600 carry a drainage class of poorly or very poorly drained, which is 46.7 percent, and the two highest-runoff hydrologic soil groups together account for 63.4 percent. The single biggest map unit in the county, the Sorter-Dallardsville complex at 97,556 acres, records a seasonal water table at the ground surface from November through May. About 11 percent of the county sits in map units the NRCS names as flooded. There is expansive clay too, on roughly an eighth of the county, and Vamont clay reads 56.5 percent clay right at the surface. Which of those two problems you have is a question about your parcel, not about the county.
Can I trust what the topsoil looks like?
Not on its own, and this is worth digging for. Several of the county's common series read sandy in the plough layer and much heavier below. Otanya very fine sandy loam is 3.6 percent clay and 71.8 percent sand at the surface, and 33 percent clay at 64 to 122 centimetres. Kirbyville fine sandy loam runs 6.5 percent clay at the top and 25.5 percent in the subsoil. Sorter, the county's most widespread soil, is only about 2.5 percent clay at the surface and is still poorly drained. Texas classifies soil for septic purposes by texture rather than by a drainage test, so the site evaluation is what settles both the drainfield and how the foundation is approached, and it should be done before the footprint is fixed.
Do I need a permit for a water well?
You need a registration, and it has to happen first. Hardin County is inside the Southeast Texas Groundwater Conservation District, whose boundaries are coextensive with Jasper, Newton, Hardin and Tyler counties. The district's Rule 3.1 says no person shall drill, modify, complete, plug or alter the size of a well within the district without first registering it, even though the well may be exempt from the requirement of a permit under Water Code section 36.117, and Rule 3.5 puts it plainly: exempted wells shall be registered with the district before drilling. A domestic well below 25,000 gallons a day still needs no operating permit, but the paperwork is not optional. The district is at (409) 383-1577.
Does my land have to be platted?
Not always, and the exemption has a consequence people miss. The county's subdivision manual reproduces the exceptions in Local Government Code section 232.0015: land used primarily for agriculture, farm, ranch, wildlife management or timber production, transfers to relatives within the third degree, and divisions in which every lot is more than 10 acres. A division into four or fewer parts, each at least one net acre with 60 feet of road frontage, can go through as a minor plat. The catch is that the manual assigns street addresses through the plat, with the 911 network signing off at that stage. Skip the plat and you skip the address, and the county's own permit application asks for the construction site physical address. The South East Texas Regional Planning Commission issues 911 addresses on (409) 347-1911.
Are there setbacks on unincorporated land here?
Yes, and they surprise people who have read that Texas counties cannot zone. That much is true, but the county's subdivision manual applies to all unincorporated areas and sets building lines of its own: 50 feet from the right-of-way edge on all state and federal roadways and county thoroughfares, 25 feet on other public roads, and a minimum of 20 feet between any structure and a structure on adjacent property. If your land falls inside a city's extraterritorial jurisdiction the manual says the municipal requirements prevail where they conflict, and the more stringent standard governs. The manual also requires a development review committee meeting at the start of any new subdivision or development, attended by engineering, the fire code official for the area, the utility district and the permit office.
What if I rent the barndominium out?
Ask before you assume the answer is the same. Some Texas counties route rental and income-producing residential through a commercial track where a fire code genuinely is enforced, and the fee basis changes with it. Hardin County does run a separate commercial and industrial development permit, priced on project cost rather than square footage, but nothing it publishes says a let dwelling goes there, and its own capability assessment records no county fire code and no building code official. There is also a statutory ceiling worth knowing: Local Government Code section 233.062(a) limits any county fire code to commercial establishments, public buildings and multifamily dwellings of four or more units, so a county fire code cannot reach a single family house whether you live in it or let it. If a rental is the plan, put the question to the permit office on (409) 246-5251 before the slab is poured.
I have more than ten acres. Am I exempt from the septic rules?
No, and TCEQ said so itself. When it amended the rule in 2023 the agency explained that the old wording had been misinterpreted by homeowners, installers, authorised agents and other stakeholders as meaning that single-family dwellings on ten acres or more were exempt from the entirety of chapter 285. Ten acres buys you out of the paperwork and the inspection, not out of the standards the system still has to meet. On land as wet as much of Hardin County that distinction matters, because the standards are what keep a drainfield working on a soil with a seasonal water table near the surface.
